FAQS ABOUT Divorce


How long does it take to finalize my divorce?

First, you or your spouse must be a resident of California for at least six months, and be a resident of the county you’re filing in three months in the county you’re filing in, before filing a dissolution of marriage. Once you file for divorce and serve the divorce petition to your spouse, you will have to wait about six months for your divorce to finalize.

What if the other party doesn’t respond to my divorce petition?

If 30 days have passed since filing a petition to divorce, you may obtain a default judgment from the court. If your spouse has not signed the divorce petition and has not discussed a divorce agreement outside of court, he or she has given up their right his or her right to participate in the divorce. It’s important to discuss with your divorce attorney what forms you will need to request a default judgment from the court.

Do I have to prove fault of the other spouse to get a divorce?

No, California is a no-fault divorce state, meaning that either one or both parties believe the marriage can’t be saved. There are two grounds for divorce: (1) your spouse suffers from incurable insanity; or (2) irreconcilable differences that have badly damaged your marriage to the point where it can’t be saved.

Is the dissolution process the same for registered domestic partnerships?

Yes, the process is the same. With domestic partnerships filed in California, you do not need to meet any residency requirements. Be aware that filing a summary dissolution is a divorce, not a legal separation.
